Trading Terms and Conditions

1. Scope and Purpose

These trading terms and conditions apply to the sale and supply of goods offered by P.Young & Partner as Internet merchant via our online web-shop.

2. Product Range

The range of goods we offer currently includes art and photo products (prints, calendars and cards) and collectible items (miniature tin soldiers and figures) from various publishers and suppliers. The different types of products are presented in individually customised websites, each with a separate Internet address. The terms and conditions are common to all, as is the use of a single payment provider.

3. Order entry - online

The goods can be viewed, ordered and paid for online, with secure entry of the chosen item or items, the billing and delivery address and the credit card details. To protect the privacy of the customer, all personal data entered is encrypted before transmission. On acceptance of our Terms & Conditions and successful conclusion of the payment transaction, the order details are mailed to us for forwarding to the relevant publisher or supplier for shipment of the goods to the delivery address.

4. Order entry - offline

Customers in Switzerland have the additional possibility of paying by invoice, for which a small handling charge is added. In this case the order details, including the billing and delivery addresses, are sent to us by e-mail without encryption, and an e-mail confirming our receipt of the order is returned to the customer.

5. Prices

All item prices are in Swiss Francs (CHF), exclusive of postage and packing which is added as appropriate. As P.Young & Partner is not liable to Value Added Tax, the prices shown are netto and do not include tax.

6. Conditions of Payment

(a) by credit card: we accept payment by Visa and MasterCard credit cards and the Swiss PostFinance direct debit card. The payment transactions are processed to the Verified-by-Visa and MasterCard SecureCode standards via the secure payment provider Saferpay.
(b) by invoice: for customers in Switzerland who choose to pay by invoice, payment is requested within 10 days of receipt of the goods.

7. Shipment and Delivery

Orders received are forwarded by us to the relevant publisher or supplier for shipment to the requested delivery address. This normally takes place within 1-2 working days after authorisation of a credit card payment or the raising of an invoice.
(a) Calendars and cards are sent by Swiss Post (B-Post, Economy).
(b) Miniature tin figures can be sent either by A-Post (Priority) or B-Post, at the customer's choice.
(c) Australian art prints are sent from Sydney by Australia Post Economy Airmail.
(d) Depending on the country of origin (Switzerland or Australia) and the delivery destination, the goods may take up to several weeks to arrive.
(e) The goods will be despatched in suitable protective packaging and should arrive in perfect condition. Should any damage have been incurred in transit, please report immediately to your local post office. Goods which are proven to be damaged on arrival will be replaced by us free of charge.

8. Returns

(a) For the sale of calendars the right of return does not apply.
(b) For other goods the customer has the right, within 10 days of receipt and without having to give a reason, to return the goods to the supplier, provided P.Young & Partner is notified immediately in writing by registered letter or acknowledged e-mail.
(c) In this case, the customer is obliged to return the consignment in full, suitably packaged and together with the original delivery documentation to the supplier's address, which will be found on the delivery documentation. Proof of return shipment is the responsibility of the customer.
(d) Should the returned goods be received in anything less than the original condition, the customer will be liable for the loss of value due to any damage or deterioration suffered. If the payment by the customer has already been settled, then any such loss of value will be deducted from the repayment due. In the worst case the loss of value may equal the original purchase price.
(e) The customer shall bear the full cost of the return shipment, except in the case that the wrong goods were supplied in the first place.
(f) On receipt of the returned goods in original condition, P.Young & Partner agrees to refund the purchase price, excluding the original postage cost, and provided that the payment has been received in full.

9. Customs and Import Duty

Goods sent abroad may be liable to customs duty on entry to the country of destination. Such taxes are not included in the cost of postage and are the responsibility of the customer.

10. Applicable Law and Jurisdiction

In the event of a dispute the laws of Switzerland will apply, under the jurisdiction of Arlesheim in the canton of Basellandschaft (BL), even in the case of orders placed from or goods sent to countries abroad.
